1. Who we are and acceptance
QueBank is operated by Buk Capital LLC in Pennsylvania, United States ("QueBank", "we", "us"). By creating an account, completing a purchase, or using que-bank.com, you accept these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use QueBank.
2. Eligibility and age
Children under 13 may not use QueBank or create an account. If you are 13 to 17, you may use QueBank only if a parent or legal guardian purchases the access, accepts these Terms on your behalf, and supervises your use. The account holder is responsible for all activity on the account, including a supervised student's use. Klarna requires the purchaser to be 18 or older and to meet Klarna's own terms.
3. Your account
Give us accurate information, keep your password private, and tell us promptly at support@que-bank.com if you believe someone else has used your account. One account is for one learner. You may not sign in through automated tools or let others use your login.
4. License to use QueBank content
While your access is active, we grant you a personal, non-transferable, non-exclusive, revocable license to view and answer questions, read explanations, and use analytics for your own exam preparation. You may not copy, scrape, record, download in bulk, share, publish, resell, translate, or use QueBank questions and explanations to train models or build another question bank or course. You may not bypass access or payment checks, probe or overload our systems, or upload harmful code. We may suspend or end access for misuse, without refund where the misuse is deliberate.
5. Purchases and access term
Each exam is sold as a one-time purchase for exactly 12 months of access from the moment payment succeeds. There is no automatic renewal: we never charge you again unless you place a new order. Buying one exam does not unlock another. Add-on quiz packs are separate one-time purchases and can only be bought and launched while the parent exam plan is active. Prices are shown in US dollars; sales tax or VAT is added where the law requires it. Prices and catalog contents may change for future purchases, but a completed purchase is governed by what was shown at checkout. Payments are processed by Stripe; we do not see or store your card number.
6. Refunds
Our Refund Policy explains the 7-day refund window, the situations we review case-by-case, and what happens to access when a refund is issued. It is part of these Terms.
7. Content accuracy and no outcome guarantee
We work hard to keep questions and explanations accurate and current, but exam content, rules and scoring change and errors happen. QueBank is a study supplement. It does not guarantee admission, licensure, certification, a passing score, a score increase, employment, or any other result. You are responsible for confirming official exam dates, eligibility, fees, accommodations, and jurisdiction-specific requirements with the exam sponsor.
8. Trademarks and affiliation
QueBank is independent. We are not affiliated with, endorsed by, or sponsored by any exam owner, including College Board (SAT, PSAT); ACT, Inc. (ACT); ETS (GRE, TOEFL); LSAC (LSAT); GMAC (GMAT); AICPA, CIMA and NASBA (CPA); PMI (PMP); FINRA (securities exams); IDP Education, the British Council and Cambridge University Press & Assessment (IELTS); state real estate commissions and licensing agencies. Exam names are used only to identify the test you are studying for. All trademarks are the property of their respective owners.
9. Copyright complaints (DMCA)
If you believe content on QueBank infringes your copyright, send a notice to support@que-bank.com with the subject "DMCA notice" that includes: your contact details; the copyrighted work; the URL or location of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner; and your physical or electronic signature. We remove or disable access to material identified in a valid notice and may terminate repeat infringers. Counter-notices go to the same address.
10. Disclaimers
QueBank is provided "AS IS" and "AS AVAILABLE". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise the service will be uninterrupted or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent the law allows, QueBank and its owners, contractors and providers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or exam outcomes, arising from your use of QueBank. Our total liability for all claims relating to the service is capped at the amount you paid us in the 12 months before the event giving rise to the claim. These limits do not apply where they cannot be excluded by law, including for fraud or gross negligence.
12. Indemnity
You agree to defend and hold QueBank harmless from claims, losses and reasonable legal fees caused by your breach of these Terms, your misuse of our content, or your violation of another person's rights or of the law.
13. Termination
You can stop using QueBank at any time and can ask us to delete your account under our Data Deletion page. We may suspend or terminate access if you break these Terms, if a payment is reversed, or if the law requires it. Sections 4 and 7 through 16 survive termination.
14. Governing law and dispute resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable US federal law, without regard to conflict-of-law rules. Please read this section carefully; it affects your legal rights.
Informal resolution first. Before starting any formal proceeding, email support@que-bank.com with the subject "Notice of dispute", describe the problem and what you want, and give us 30 days to resolve it with you.
Binding individual arbitration. If we cannot resolve the dispute within 30 days, either of us may require it to be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator applies these Terms and Pennsylvania law and may award the same individual relief a court could. Arbitration takes place by video, by documents, or in Allegheny County, Pennsylvania, at your choice.
Class action and jury waiver. You and QueBank each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative action, and each waives the right to a jury trial. If this waiver is found unenforceable for a particular claim, that claim proceeds in court, not in arbitration.
Small claims and opt-out. Either party may bring an individual claim in small-claims court instead of arbitration. You can opt out of arbitration by emailing support@que-bank.com with the subject "Arbitration opt-out" and your account email within 30 days of first accepting these Terms; opting out does not affect any other part of the Terms. Anything not subject to arbitration must be brought in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms as the service or the law changes. For material changes we will give notice by email to your account address or by a notice on the site at least 14 days before the change takes effect, and we update the date at the top of this page. Continued use after the effective date means you accept the new Terms. Changes do not apply retroactively to a dispute that arose before them.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, Refund Policy and Purchase & Access Policy, are the entire agreement between you and QueBank about the service and replace any earlier understanding. You may not assign your account or rights; we may assign ours to a successor of the business. Our failure to enforce a term is not a waiver of it.
